Terms of Service
The agreement between you and Out The Dealer for our vehicle negotiation service.
1. What we provide
We provide a professional vehicle negotiation service. We contact dealerships, compare offers, analyze deal structures, and negotiate on your behalf. We are not a dealership, auto broker, lender, insurer, or lead-generation service, and we do not sell vehicles.
2. Fee
The service fee is a flat $300, paid upfront. The fee compensates us for the negotiation service itself — our time, expertise, research, dealership communication, and negotiation. It is not a deposit toward a vehicle and is not contingent on the purchase of a vehicle.
3. No purchase guarantee
We do not guarantee that you will purchase a vehicle, that you will qualify for financing, that you will accept a negotiated deal, that a dealership will accept our offers, or that a particular vehicle will remain available. You are free at all times to accept or reject any deal we negotiate.
4. The $1,000 Better-Deal Guarantee
The $1,000 Better-Deal Guarantee applies only to qualifying written dealership offers and is subject to the guarantee terms, which are incorporated into these terms by reference.
5. Your responsibilities
- Provide accurate, complete, and timely information.
- Provide reasonable geographic flexibility, generally including willingness to consider dealerships within approximately 100 miles.
- Refrain from separately negotiating with the same dealerships in a way that undermines the negotiation we are conducting on your behalf.
- Make your own final decision regarding any purchase, trade-in, or financing.
6. No financial, legal, or tax advice
Nothing we provide constitutes financial, legal, tax, or insurance advice. Financing approval and lender terms are controlled by lenders and dealerships. Vehicle pricing, inventory, and availability are controlled by dealerships.
7. Limitation of liability
To the maximum extent permitted by California law, our total liability arising from the service is limited to the amount of the service fee paid. We are not liable for indirect, incidental, or consequential damages.
8. Governing law
These terms are governed by the laws of the State of California.
